Meeting with CMD,Dir HR and PGM Pers BSNL on SEWA’s Stand on reservation on roster

We are receiving many queries from our members in reference to SNEA’s message posted on its website on 02.12.2020 regarding SEWA’s stand on reservation roster. In this regard it is informed that Shri N D RAM GS, SEWA along with Shri RA Meena AGS(Central) met PGM(Pers.) on last Friday (04.12.2020) and discussed the matter in detailed. Thereafter this matter is also discussed by GS with Dir(HR) on the same date & with CMD BSNL along with Sh. Satyaveer Singh AFS on 08.12.2020.

PGM(Pers.) informed us that after DoT clarification vide its OM dated 13.10.2020, addressed to Lok Shabha Secretariat with copy to CMD BSNL, it is not feasible to issue promotion order in any cadre with reservation roster as it would lead to contempt of Hon’ble Supreme Court of India in view of its Order dated 22.7.2020 in IA No.53895/2020 (which was filed by the Union of India seeking Adhoc promotion to the large number of vacant post subject to final outcome in the related cases) wherein Hon’ble Supreme Court of India did not pass any orders allowing Adhoc promotion and only directed that IA may be considered at the time of final disposal of the main matter.

Copy of DoT OM dated 13.10.2020 is also again circulated for your perusal.

PGM(Pers.) told that as the matter is still pending for final adjudication of Hon’ble Supreme Court of India, so the only options remain is either to proceed with the promotion without reservation roster or wait till the final judgment by Hon’ble Supreme Court of India in the batch of cases [ SLP(C) 30621/2011 & connected matters].

PGM(Pers.) further informed that they can issue promotion order from JTO to SDE(T) covering JTO(T) 2008 batch thereby covering maximum number of executives of all categories.

You all are aware that SNEA is trying its best to implement CPSU Hierarchy. Needless to mention that this CPSU hierarchy {BSNL Executive Promotion Policy Amendment and Rect Rules 2017 (BEPPARR 2017} proposes to abolish all the existing post thereby making the Post based promotion inapplicable and hence, the concept of this scheme is itself against the Rules of reservation. So SNEA is always interested to stop the post based promotion to justify its claims that promotion can be given only through this proposed policy.

In view of above, we have already asked our CP & CS of all Circles to discuss all pros & cons of the matter with our Members/Office Bearers and to provide their inputs in this regard to GS SEWA and their concerned CHQ Governing Body Members. We have already scheduled the CHQ Governing Body meeting (through Zoom App) on 13.12.2020 the coming Sunday at 11.00 AM for further discussion as per the present situation and decision in the matter will be taken as per advice of Hon’ble Parliamentary Committee.
